[SCOTUSBlog] Test post: In the Internet access case, the Court will be reviewing a plea by the FCC and by cable operators to uphold an FCC ruling that cable broadband services that offer computer users high-speed links to the Internet are solely an "information service," almost completely free of regulation by federal or local authorities. The Ninth Circuit, however, refused to defer to the FCC approach, saying that it was bound to follow its own prior ruling in 2000 in the City of Portland case. In that ruling, the Circuit Court found that cable modem service is at least partly a telecommunications service, meaning that a cable operator would have to open its cable modem facilities to all Internet Service Providers, not just its own in-house ISP.
